Please read these Terms of Service carefully before using VDI Agent. These Terms constitute a legally binding agreement between you and Christian Fiorillo / VDI Agent.
01 // ACCEPTANCE OF TERMS
By downloading, installing, or using VDI Agent (the "Software") or by accessing vdiagent.ai (the "Website"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, do not use the Software or Website.
We may update these Terms from time to time. Continued use after changes constitutes acceptance. Material changes will be notified by email to registered users.02 // SERVICE DESCRIPTION
VDI Agent is a Windows desktop application that acts as a productivity tool and AI proxy for users operating within Virtual Desktop Infrastructure (VDI) environments such as Citrix, RDP, Azure Virtual Desktop, and AWS WorkSpaces. The Software runs on the host PC and forwards queries to AI providers selected by the user. AI responses are returned to the user via an overlay interface. VDI Agent is a productivity tool designed to assist with work tasks within your authorized environment.
03 // USER RESPONSIBILITY & COMPLIANCE
You are solely responsible for your use of VDI Agent and compliance with your employer's policies and applicable laws. ► VDI Agent is a productivity tool, not designed to circumvent security controls or corporate policies. ► Beren Software does not encourage violation of corporate IT policies or security measures. ► Beren Software is not responsible for any disciplinary action from your employer resulting from your use of the Software. ► You are responsible for ensuring your use complies with your organization's acceptable use policies. ► You acknowledge that your employer may monitor software usage on company-provided devices.
04 // DATA & PRIVACY
Your data privacy and security are paramount: ► Zero-retention proxy: AI queries are not stored on our servers. Requests are forwarded directly to your chosen AI provider. ► Client-side PII scrubbing: Before transmission, the Software automatically removes personally identifiable information including file paths, email addresses, hostnames, and URLs. ► No clipboard monitoring: The Software does not access or log your clipboard. ► No screen capture storage: Screen content is processed in real-time and not persistently stored. 05 // TELEMETRY & DATA COLLECTION
Telemetry and usage analytics are disabled by default: ► You must explicitly opt-in to telemetry collection via settings. ► Telemetry covers only non-sensitive metrics: query count, model selection, error rates. ► Prompt content is never collected or analyzed. ► You may disable telemetry at any time. This commitment ensures your privacy while helping us improve the Software.
06 // WARRANTY DISCLAIMER
The Software is provided "AS IS" without any warranties: ► We do not warrant that the Software will be error-free, uninterrupted, or suitable for your purposes. ► We do not warrant the accuracy or completeness of AI-generated responses. ► We disclaim all express and implied warranties, including merchantability and fitness for a particular purpose. ► Use of the Software is at your own risk.
07 // LIABILITY LIMITATION
To the maximum extent permitted by applicable law: ► Our total liability for any claim arising from use of the Software shall not exceed the amount you paid us in the 12 months preceding the claim. ► We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. ► We are not liable for decisions made based on AI-generated responses. Nothing in these Terms limits liability for fraud, gross negligence, or death/personal injury caused by our fault.
08 // ENTERPRISE DEPLOYMENT
For organizations requiring IT governance and enhanced compliance: ► Beren Software offers Enterprise tier licensing with dedicated support. ► Enterprise deployments may include: single sign-on (SSO), audit logging, and IT policy integration. ► Enterprise customers can work with our team to ensure compliance with organizational security and data handling requirements. ► Contact legal@berensofware.com for Enterprise licensing inquiries.
09 // INTELLECTUAL PROPERTY
VDI Agent, its logo, design, and Website content are the intellectual property of Beren Software and are protected by copyright and other applicable laws. You are granted a limited, non-exclusive, non-transferable license to use the Software solely for your own internal business purposes in accordance with the plan you subscribed to. Nothing in these Terms transfers ownership of any intellectual property to you.
10 // GOVERNING LAW
These Terms are governed by and construed in accordance with Italian law and, where applicable, EU law. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Italy, unless mandatory consumer protection law in your country of residence provides otherwise.
